On Behalf of | Sep 19, 2019 | Products Liability

When an Ohio victim has been injured by their airbag, which they understood was there to keep them safe, they may wonder what they can do about it. Products liability law provides protections to help victims of defective airbags with the damages they suffer.

Unfortunately, airbags can injure victims in a variety of different ways, including if the sensors malfunction which cause the airbag to prematurely inflate or to inflate late, if the airbag fails to deflate or if the airbag exposes the victim to chemicals. Other types of defects and damages have also been reported with airbags. These types of problems can lead to serious injuries, such as facial abrasions and burns, for victims and even death in some instances.

Products liability is an area of the law that protects victims from harm suffered because of a defect associated with an everyday product. In a products liability claim, liability may extend throughout the chain of distribution of the defective product. In circumstances of a defective airbag, damages may be sought from the manufacturer of the airbag, the manufacturer of the car or others.

There are different legal theories upon which a products liability claim may be based and the best option depends on the situation and circumstances. Having trained guidance to help the victim decide which option is best is useful.

Victims of defective airbags and other product defects may be able to recover compensation for the physical, financial and emotional injuries they suffer. Harm that may be compensable to victims include medical expenses, lost wages and pain and suffering damages. Because of the remedies and resources available to them, injured victims should be familiar with products liability legal protections and how they can help them.
